Full Ts & Cs

1. These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry and claim instructions are deemed to form part of the Terms and Conditions and by participating, all entrants will be deemed to have accepted and be bound by the Terms and Conditions. Please retain a copy for your information.

2. Promoter: Magners GB Limited, c/o Matthew Clark, Whitchurch Lane, Whitchurch, Bristol, BS14 0JZ.

3. Eligibility: This promotion is open to UK residents aged 18 and over only, excluding the Channel Islands and the Isle of Man, and excluding employees and the immediate families of the Promoter, its subsidiaries, other group companies, its agents, suppliers, or anyone else professionally connected with this promotion.

4. Promotion Period: The promotion will run 09:00 31.05.23 – 23:59 31.10.23. Prizes will be awarded on 01.11.23. Entries outside of this period will not be accepted.

5. To enter: No purchase is necessary. Scan the QR code on promotional bottles of Menabrea (660ml individual bottles) OR simply go to www.menabrea.co.uk/win during the Promotional Period and enter your name, email address and telephone number for your chance to win. Internet access required. Promotional bottles are subject to availability and whilst stocks last.

6. Internet access required. Participants are responsible for their own costs associated with accessing the internet. These costs may vary so please check with your service provider for current charges. Participants should seek the permission of the person paying the bill before entering.

7. Maximum of one entry per person. Anyone entering more than once per day using multiple identities, multiple accounts or computerised or automated system will be disqualified from the promotion. Maximum of one prize per person.

8. Entrants who make an entry on someone else’s behalf will be disqualified, at the Promoter’s discretion.

9. Entries (bulk or otherwise) made from trade, consumer groups, syndicates or third parties will not be accepted. If it becomes apparent that a participant is reposting the same content multiple times or using a computer(s) to circumvent this or any other condition by, for example, the use of ‘script’, ‘brute force’ or any other automated means, that person’s entries will be disqualified, and any prize award will be void.

10. Incomplete, illegible, invalid or misdirected entries will not be accepted. Proof of sending will not be accepted as proof of delivery. The Promoter takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise.

11. No alternative prizes will be provided in whole or in part, except that in the event of circumstances outside of its control the Promoter reserves the right to substitute similar prizes of equal or greater value. The prizes are non-transferable, non-refundable and cannot be sold or auctioned.

Prizes:

13. There are a total of 101 prizes to be won in the prize draw. Prizes compromise of:

  • Tier 1 Prize: 1 Ultimate private dining experience for the winner and up to 7 guests that will be arranged to suit the winner’s availability and location (subject to location availability). Subject to location, timings, the location selected by the winner and availability, the private dining experience prize includes: o 1 evening spent at a luxury house/apartment in the UK where the private dinner will take place (please note the dining experience will not take place in your home); o Travel to and from the selected location from one mutually agreed collection point, to be agreed with the winner in advance. £50 per person will be provided to the winners to cover their preferred travel costs. A form requesting the winner’s full name and bank details will be requested from the winners so this can be reimbursed; o Italian games hamper; o Italian themed catered ‘family style’ dinner with chilled Menabrea. Subject to availability and location, dinner is to be provided by means of a private chef who will cater for any dietary requirements; and o A drinks package, including soft drinks, water and Menabrea.
  • Tier 2 Prizes (GB): 100 £40 Italian themed at home dining kit vouchers and 100 4 packs of Menabrea. Maximum 1 voucher and 1 4 pack of Menabrea available to be won per person.
  • Tier 2 Prizes (NI): 100 £40 Italian themed at home dining kit vouchers and 100 660ml bottles of Menabrea. Maximum 1 voucher and 1 660ml bottle of Menabrea available to be won per person.

14. Additional terms applicable to Tier 1 prize: The private dining experience must be used by 30th August 2024. T&Cs specific to a chosen venue may apply, these may be provided to the winner prior to the prize being awarded. Private dining experience is subject to availability and cannot be used over Christmas, New Year and other bank holidays. Travel insurance is not included. The private dining experience is available for winner and up to 7 guests, but all guests must be over 18, proof of ID may be required. In participating in the dining experience, entrants must follow any Government travel guidelines in place at the time. The winner acknowledges that they and their guests may be required to provide proof of COVID-19 status and/or proof of vaccination against COVID-19, and that they may be refused entry to the location if they are unable to provide the required proof. The winner and guests are responsible for all expenses not expressly stated in these Terms and Conditions as being included as part of the prize.

15. Additional terms applicable to Tier 2 (GB) prizes: Once their win has been verified, their voucher will be sent to them via email within 7 working days and their home address will be requested in order to send the 4 pack of Menabrea to the winner within 28 days of address confirmation.

16. Additional terms applicable to Tier 2 (NI) prizes: Due to legislation in Northern Ireland, parcels delivered from the UK cannot contain more than one litre of alcohol. One 660ml bottle of Menabrea will therefore be sent to winners of the Tier 2 prizes if their home address is in Northern Ireland as an alternative to a 4 pack. Once their win has been verified, their voucher will be sent to them via email within 7 working days and their home address will be requested in order to send the 660ml bottle of Menabrea to the winner within 28 days of address confirmation.

Prize Notification:

  • Tier 1 prize winners: These winners will be notified by the Promoter/their agent within 3-5 working days of the prize draw taking place via an email confirmation. This email will be sent from Cloud 9 Incentives and will contain details of the prize won and how to claim. Entrants are encouraged to monitor their email (including spam/junk folders) account during this time in case they are a winner.
  • Tier 2 prize winners: These winners will be notified by the Promoter/their agent within 3-5 working days of the prize draw taking place via an email confirmation. This email will be sent from Cloud 9 Incentives and will contain details of the prize won. Entrants are encouraged to monitor their email account (including spam/junk folders) during this time in case they are a winner.

Prize Redemption:

  • Tier 1 Prize: To complete the verification process and arrange their prize, winners will have to reply to the email sent by the Promoter/their agent claiming that they wish to claim the prize within 10 working days from first contact. The winners age will be verified thereafter, and they will be contacted by email within 2-3 working days and asked to submit a photocopy of a valid UK driver’s license or passport to verify this. In cases where a response is not received in time or a winner is ineligible or rejects their prize, another winner will be selected using the same methodology as above. This process will be repeated once before any unclaimed secondary prizes will be allocated to a wrap up draw.
  • Tier 2 Prizes (UK) : To complete the verification process and arrange the delivery of their prize, winners will have to reply to the email sent by the Promoter/their agent claiming that they wish to claim the prize within 10 working days from first contact. The winners age will be verified thereafter, and they will be contacted by email within 2-3 working days and asked to submit a photocopy of a valid UK driver’s license or passport to verify this. Once their win has been verified, their voucher will be sent to them via email within 7 working days of winner verification. Winners will also be asked for their full home address in order for their 4 pack of Menabrea to be sent to them within 28 working days. In cases where a response is not received in time or a winner is ineligible or rejects their prize, another winner will be selected using the same methodology as above. Wrap up Draw:

  • Wrap up Draw: All unclaimed prizes and in cases where responses are not received in time or a winner is ineligible or rejects a prize, the prize will be reallocated to a wrap up draw where another winner will be selected after the promotional period ends. The unclaimed Tier 1 prize will be drawn first, followed by unclaimed Tier 2 prize draw prizes. Winners will be selected from all losing valid entries by a randomised computer process. The wrap up draw will take place by 5pm on 24.11.23. Winners of the wrap up draw will be notified via the email address used for entry and will be supplied with ‘how to claim’ details. Winners have 10 working days from first contact to respond by confirming they claim their prize and providing their date of birth and valid ID. Age and ID will be verified by asking for a scanned copy of their photographic ID (valid driving licence, passport or equivalent accepted). In the case that they do not respond in time or are ineligible another winner will be selected using the same methodology as above. This process will repeat twice before all unclaimed prizes will be null and void.

19. If fulfilment or any element of this promotion will be delayed or affected due to Covid-19 and resulting Government restrictions, all entrants affected will be contacted by the Promoter and kept updated of any unavoidable changes to the promotional dates, revised fulfilment dates or prizes.

20. It is the responsibility of the entrant to provide correct, up-to-date details when entering the promotion and on acceptance of their prize. The Promoter cannot be held responsible for winners failing to supply accurate information which affects prize acceptance or delivery of their prize.

21. The Promoter reserves the right to verify all entries including but not limited to asking for proof of address and photo ID (passport, driving licence or equivalent) which the entrant must provide within 10 working days. The Promoter reserves the right to refuse to award a prize or withdraw prize entitlement and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions, the spirit of the promotion, any instructions forming part of this promotion’s entry requirements or otherwise where a participant has gained unfair advantage in participating or won using fraudulent means.

22. The Promoter will make available the prize winners’ surnames and counties of residence to members of the public or regulators who request such details within 3 months of the closing date of this promotion. Entrants can object to disclosure, or request that disclosure be limited in scope by contacting winner@multiplyagency.com. We may nevertheless disclose the information to the Advertising Standards Authority if required to do so. You may request a copy of the winners’ details by emailing winner@multiplyagency.com.

25. Prizes cannot be sold or transferred. Winning prizes cannot be combined with other discounts, cashback activities or promotions. The prizes are not refundable and cannot be exchanged for cash or other goods and services.

26. In the event of any dispute, the decision of the Promoter is final, and no correspondence will be entered into.

27. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligation but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.

28. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using any prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.

29. The Promoter has no control over internet or communication networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter will not be held liable to any individual for any fraud committed by any third party nor for any event beyond its control including, but not limited to, user error and any network, computer, hardware or software failures of any kind which may restrict, delay or prevent a participant’s entry to the promotion.

30. If any of these conditions should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining conditions shall survive and remain in full force and effect.

31. This promotion is administered by Multiply UK, 1-2 Sciennes Gardens, Edinburgh, EH9 1NR, Scotland on behalf of the Promoter. The prizes will be fulfilled by Cloud 9 Incentives, The Station, 7 High Street, Olney, Bucks, MK46 4EB.

32. The Promoter will only use the personal details supplied for the administration of the promotion and for no other purpose, unless we have your consent. You acknowledge that the Promoter may pass such information to its third-party agency, solely for the purposes of administering the promotion. Your personal details will at all times be kept confidential and in accordance with current Data Protection legislation. The Promoter’s Privacy Policy can be found at: https://www.menabrea.co.uk/privacy-policy/. You can request access to your personal data, or have any inaccuracies rectified, by sending an email to GDPR@candcgroup.com . All data provided by winners in the promotional period will be destroyed 12 weeks after the close of the main promotion. By participating in the promotion, you agree to the use of your personal data as described in this condition.

33. Any question concerning the legal interpretation of the rules will be based on Scottish law and the Courts of Scotland will have exclusive jurisdiction unless you live in England, Wales or Northern Ireland, in which case your local courts will have jurisdiction.
